Please note the following changes to the Questions and Answers document regarding the Developmental Disability Support and Care Coordination Organization (DISCO) Certificate of Authority (COA) and Start-Up Grant. 26.   A.)  Does an organization need to be fully organized (i.e., Articles of Incorporation filed and approved by the Department of State) in order to submit a grant application?
Response:
A.) Yes, the organization must be established as a separate legal entity from the provider(s) forming the organization.  For example, if the organization will be a corporation, it must be incorporated, i.e., have a certificate of incorporation filed with the Department of State.  The organization could then amend the certificate of incorporation to add the authority to operate a DISCO and request Department of Health approval of the amended certificate of incorporation.

26. B.)  May the provider entity that intends to sponsor the DISCO apply for the grant on behalf of the soon to be formed DISCO?
Response:
B.)   No

33. The OPWDD Certificate of Authority Application indicates that the organizational structure “[m]ust be in place, including Articles of Incorporation and Department of State Approval” prior to applying for the start-up funds.  Please confirm this must be in place as stated.
Response:
Yes, the organization must be established as a separate legal entity from the provider(s).  If the organization will be a corporation, it must file a certificate of incorporation with the Department of State.
